2. Description of Service
Vakalat Diary is a legal practice management platform that provides case tracking, document creation, hearing management, notification services, and related tools for legal professionals.
3. User Eligibility
- You must be a legal professional or authorized representative of a law firm
- You must be at least 18 years old
- You must provide accurate registration information
4. Account Responsibility
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activity under your account
- You must notify us immediately of any unauthorized access
5. Acceptable Use
You agree NOT to:
- Use the service for any unlawful purpose
- Share your account with unauthorized persons
- Attempt to access other users' data
- Upload malicious content or files
- Reverse engineer or copy our platform
6. Data Accuracy
You are solely responsible for the accuracy of data entered into the platform. We do not verify case numbers, court details, or legal information entered by users. Auto-filled templates are starting points and must be reviewed by the lawyer before filing.
7. Document Templates Disclaimer
IMPORTANT: Document templates provided are for reference and convenience only. They are NOT legal advice. Users must:
- Review and customize all templates before use
- Ensure compliance with applicable court rules and procedures
- Verify all legal citations and sections
- Take full responsibility for documents filed in court
8. Notification Disclaimer
WhatsApp and email notifications are provided as a convenience. We do NOT guarantee delivery of notifications. Users should not rely solely on our notification system for court date reminders. We are NOT liable for any consequences of missed notifications.
9. Voice Notes / Audio Recording Disclaimer
CRITICAL: The Voice Notes feature is provided EXCLUSIVELY for lawyers to record their personal case observations, hearing summaries, and legal notes. It is expressly understood that:
- This feature must NOT be used to record court proceedings. Recording inside courtrooms, judge chambers, or court premises is prohibited under the Contempt of Courts Act, 1971 and may result in imprisonment, fine, and disbarment.
- Users must NOT record conversations with other persons without their explicit consent, in compliance with applicable privacy laws.
- Users must ensure they are NOT inside court premises when using this feature.
- The platform is NOT responsible for any misuse of the recording feature. Users take full and sole responsibility for all recordings made.
- By using this feature, users confirm they understand and accept these restrictions.
- The platform reserves the right to disable this feature for any user suspected of misuse.
10. AI Features Disclaimer
AI-generated transcriptions, summaries, and extracted data are provided for reference only. They may contain errors. Users must verify all AI-generated content before relying on it.
10. Subscription and Billing
- Free plan: 5 cases, limited features, no time limit
- Paid plans: Billed monthly or yearly as selected
- Cancellation: You may cancel anytime. Service continues until end of billing period
- Refunds: No refunds for partial months. Annual plans refundable within 7 days
- Price changes: 30 days advance notice for any price increases
11. Data Ownership
You retain full ownership of all data you enter into the platform. We do not claim any rights over your case data, documents, or other content.
12. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors beyond our control.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, or consequential damages
- We are not liable for missed court dates, filing deadlines, or legal malpractice
- Our total liability shall not exceed the amount paid by you in the preceding 12 months
- We are not liable for actions taken based on AI-generated content
14. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the service, including claims by your clients or third parties.
15. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
16. Termination
We may terminate or suspend your account for violation of these terms. Upon termination, you may request export of your data within 30 days.
17. Changes to Terms
We may update these terms. Continued use after changes constitutes acceptance. Material changes will be notified via email.
